How to apply for a tourist licence in Madrid
You file a responsible declaration (declaración responsable, a sworn statement) with the region under Decree 79/2014, together with a floor plan signed by a technician, and the dwelling enters the CIVTUR register. In the capital, the hospitality plan adds planning requirements - an independent entrance in most cases - that block most new tourist flats in the centre.
The regional filing is the easy half
Decree 79/2014 governs tourist-use dwellings across the Comunidad de Madrid. You file a responsible declaration and attach a floor plan signed by a qualified technician - an architect or similar - and the dwelling enters the CIVTUR register. Outside the capital, in a town like Alcalá or Aranjuez, that is broadly the process.
In the capital, planning is the real gate
The city of Madrid layers its hospitality plan on top of the regional rules, and that plan decides whether your flat can operate at all. Its planning requirements - an independent entrance for guests in most cases, so they never use the neighbours' portal - are what most ordinary flats in the centre cannot meet. In practice, this blocks new tourist flats across much of central Madrid.
The regional declaration does not test this. You can file it, receive the entry and start letting, and still fall at the first municipal inspection because the building's entrance was never compliant. Check the planning position with the city before you file - not after a sanction file opens.
