Do estate agents have to register in Spain?

It depends on the region. Catalonia has required registration since 2010 through the AICAT register, and the Valencian Community since 2022 through the RAICV. Andalusia created its own register under Ley 5/2025, in force from January 2026, though it is not yet accepting filings while the implementing regulation is pending.

Andalusia - duty in force, register not yet open

The 2025 Housing Law creates a public, free and compulsory register for anyone working in residential property intermediation in Andalusia. The duty has been in force since 24 January 2026. The register itself must be operational by January 2028 at the latest.

There is nothing to file in the meantime. What is worth doing is getting ready with what the regime will require: a financial guarantee over client money, professional liability insurance in proportion to your turnover, and no criminal record connected to real-estate activity.

Valencia - RAICV

Decree 98/2022 makes registration compulsory to practise. You need 200 hours of accredited training, professional indemnity insurance, and a guarantee over client money.

The specific amounts for that insurance and guarantee are under challenge: a December 2024 judgment of the Valencian High Court, following a case brought by the competition authority, is reported to have annulled the figures set in the decree. We do not reproduce them here until we have read the judgment. If you are preparing to register, confirm the current figures with the register itself before buying cover.

Catalonia - AICAT

Decret 12/2010 obliges every person or company wishing to act as an agent to register. Without a related university qualification, you must take the official course approved by the Generalitat (the Catalan government). You also need liability insurance and a surety bond.

Everywhere else

Madrid has said it intends to create a compulsory register. About the remaining regions we claim nothing here: we have not read their rules, and saying "voluntary" or "none" without checking is exactly the error this page exists to avoid. The variation is real, though - an agency operating in two regions answers to two different regimes, so check yours rather than assuming.
