Can my community of owners block holiday letting?

Yes. Since 2025, a Spanish community of owners can block tourist letting under the Horizontal Property Law (Ley 49/1960, art. 17.12). It takes a three-fifths majority of owners who also hold three-fifths of the participation quotas. In Sevilla, around 42% of communities have already voted to do so.

What happens to a licence you already hold

The licence is not cancelled - it stays on the regional tourism register. What you lose is the right to carry on the activity in that building. That distinction is uncomfortable: a registry check will keep saying the property is registered while the community's vote is stopping it.

This is why a complete check does not end at the regional register. Only the owner or the agency knows the state of the community of owners. That information belongs in the file alongside everything else.

And for new registrations

In Andalusia the community reaches the registration too, through Decree 31/2024, but in a narrower form. Your responsible declaration must state that the constitutive title (the building's founding deed) or the community statutes do not prohibit tourist accommodation. You declare the absence of a ban - not a vote in favour.
